Consumer Health Data Privacy Policy

This Consumer Health Data Privacy Policy explains how KBS Research LLC ("Regarding Your Gut," "we," "us") collects, uses, and shares "consumer health data" as defined by applicable state laws, including the Washington My Health My Data Act, the Nevada Consumer Health Data Privacy Law (SB 370), and the Connecticut Data Privacy Act. It supplements our general Privacy Policy. Where this policy and the general Privacy Policy conflict as to consumer health data, this policy controls.

What we mean by consumer health data. Information that identifies your past, present, or future physical or mental health status. For us, this can include the digestive symptoms you tell us about (such as gas, bloating, pressure, reflux, or bowel habits), information about medications or supplements you use (such as antacids, PPIs, or GLP-1 medications), and the gut "archetype" or product recommendations we generate from your responses.

The consumer health data we collect, and why.

• Quiz and self-assessment responses. The symptoms, timing, medication and supplement use, and preferences you enter into our gut quiz. Purpose: to generate your personalized result, route you to relevant education and products, and, if you opt in, to send you related email content.
• Purchase and product-interest information. The gut-health products you view or buy, to the extent it reveals a health condition. Purpose: to fulfill orders and provide relevant support.
• Information you send us directly. For example, questions you email to our support team. Purpose: to respond and support you.

Where we collect it from. Directly from you (the quiz, forms, email, purchases) and, where applicable, from service providers that help us operate the site and our email program on our behalf.

When we ask for your consent. We collect consumer health data only after you have agreed, or where it is necessary to provide a product or service you asked us for. Quiz questions beyond what is needed to give your result are optional, and you can choose "prefer not to say."

How we share it, and how we don't.

• We share consumer health data only with service providers ("processors") who act on our instructions to operate our website and our email program. Our gut quiz is built and operated by us on our own website, so your quiz responses are not sent to any third-party quiz provider. The processors we use are Shopify (website and commerce hosting) and Klaviyo (email). We share only what is needed to provide the service to you.
• We do not sell your consumer health data. We will not sell it without a valid written authorization from you, as the law requires.
• We do not share your consumer health data with advertising platforms for targeted or cross-context behavioral advertising (for example, Meta, Google, or TikTok), and we do not use it to target ads to you, without your separate, specific consent.
• We may disclose consumer health data if required by law or to protect rights and safety, as described in our general Privacy Policy.

Categories of third parties we may share consumer health data with. Service providers and processors that host our website and store, deliver our email, and support our customer service. We do not share consumer health data with data brokers or advertising networks.

Your rights. You have the right to confirm whether we are processing your consumer health data and to access it, to withdraw your consent to our collection and sharing, and to request that we delete it, including asking us to notify our service providers to delete it. We will not discriminate against you for exercising these rights.

How to exercise your rights. Email support@regardingyourgut.com or write to KBS Research LLC, 15770 N. Dallas Parkway, Ste 550, Dallas, TX 75248. We will verify your request and respond within the timeframe the law requires. You may designate an authorized agent to act for you.

No geofencing around health facilities. We do not use geofences around any health-care facility to identify or track consumers or to send them advertising.

Changes. We will post any changes here and update the effective date.
